This distinguishable case involves California FAIR Plan's (CFP) denial of senior nurse Pamela Jane Nye's 2025 Palisades wildfire property-damage claim after CFP accepted— and retained to date—her October 28, 2024 annual policy-renewal payment.
 
Nye challenged the denial through two unsuccessful appeals to CFP executive management. The California Department of Insurance subsequently initiated an investigation, and CFP issued its final executive-level denial on May 14, 2026. Nye now faces the prospect of lengthy and costly litigation to resolve the dispute.
 
Before filing suit, Nye is asking CFP to reconsider its denial, reinstate her coverage, and provide all benefits available under the policy, together with reimbursement for additional wildfire-related living expenses she says she incurred.

SUMMARIZED AND EVIDENCE SUPPORTED
March 29, 2026: FedEx tracking records and delivery photo document that CFP's envelope, identified “DC FIRE RETURN PREMIUM REFUND,” was left on the porch floor at Nye's temporary residence without a required delivery signature. The delivery record therefore does not establish who took possession of the envelope.
• Bank records confirm that on November 1, 2024, the California FAIR Plan (CFP) received and deposited Pamela Jane Nye's October 28, 2024, annual policy-renewal check for $2,942—the full renewal amount due.
• March 29, 2026: Nearly 17 months after receiving Nye's $2,942 policy-renewal payment, CFP sent a FedEx package containing a check identified as a “DC Fire Return Refund” to Nye's temporary Huntington Beach residence without her prior knowledge, request or approval. The package was left at the residence and discovered by a third party, who notified Nye. Nye did not accept possession of or negotiate the refund check, which remains uncashed, unnegotiated, and in the third party's custody.
• To date, Nye has never received the benefit of CFP's purported $2,942 refund as the refund check remains unaccepted, uncashed and unnegotiated.
• September 22–23, 2025: CFP records acknowledge Nye's renewal-premium payment and formally deny her wildfire claim on the stated ground that her policy had terminated for “nonpayment of premium.”​
• November 6, 2025: CFP's CEO and Claims Department received Nye's written claim appeal and supporting documentation challenging CFP's denial.
• CFP Claims staff directed Nye to contact her Farmers insurance agents, stating that the agents had been sent copies of CFP's “payment due, late payment warnings, cancellation and premium return notices.”
• March 10, 2026: The California Department of Insurance (CDI) received Nye's complaint disputing CFP's claim denial and initiated an investigation.
• April 2026: Nye submitted a second appeal to CFP executive management, again challenging the claim denial and providing supporting documentation concerning her $2,942 policy-renewal payment.
• May 14, 2026: Following Nye's executive-level appeals and submission of supporting documentation, CFP issued its final executive-level denial of her wildfire claim.
